Covering 3rd brake light fails an MOT?

Mot requirements are - any brake light/lamp fitted as standard or fitted and is known to be electrically connected must work and min 50% is visible.

Also if there are say 6 bulbs that make up the entire light strip and 4 do not work it would be a RFR on the 50% rule. Check out www.motester.co.uk for more (y)
 
the masks also let in some light round the edge, heres a pic of mine.
No comments about how dirty the car is!!

on a mid 90s bmw 3 series my mate had most of the bulbs in the spoiler brake light go, and the MOT station told him leave it connected and it will fail, disconnect it and it will pass.

H edisconnected it, has the car still today and has passed its MOT every year and not just at that garage.

Looks like it could be a grey area

The ones in the spoiler type normally get passed if not working as spoiler could have been fitted as a AM job - therefore there is a issue as to whether it's connected or not. Normally working on a particular brand you know whether something is standard fit or not, if it was just a MOT station for instance you might not know if something is standard fit or not.

I guess it's up to the tester - my brava failed for 3rd light not working and the tester said as long as I had one light in the strip working it would pass. I tried the disconnected thing but it didn't wash with him. Eventaully I fixed it so 2/10 bulbs worked and he passed it.

Since it only has to have a working light if the car has one, presumably if you remove the light and assembly altogether it would just pass on the basis that there is no 3rd light!
 
MOT will be testers discretion.

Its the Construction and Use regs I would worry about. Every light which is fitted, original or added, must work properly. Disconnecting it won't do. 3 points plus a fine if a passing officer decides its not working properly, or a VDRS form if hes in a good mood.
