Hi all,

I am wondering if anyone can help me.

I bought a second hand car in 2014 from Stoneacre Grantham for £7,000 and the salesman who sold it to me (who actually was the branch manager) offered me lifetime warranty for the car for £1000. I took him up on his offer and had the lifetime warranty added ONTO the value of the vehicle - bringing the total goods value up to £8,000.

I've now had an issue with the vehicle which I would like to claim on the warranty for - however Stoneacre are telling me that they have no record of me purchasing the warranty. Having trawled through the masses of paperwork I was given when buying the car I have managed to provide proof that I do in fact have lifetime warranty, but Stoneacre are backtracking saying that they never add the warranty price onto the value of the vehicle and therefore it must have been given to me for free...

I am PLEASE asking if anybody has also purchased vehicle lifetime warrant from Stoneacre and also had the warranty price added onto the value of the vehicle?

I have contacted two different Stoneacre branches pretending to be a new customer and both advisors have told me you cannot get lifetime warranty for free ever. Citizens Advice Bureau have told me that if I can get confirmation in writing from another customer that they also had the warranty price placed on the goods price then I can strengthen my claim and get my problem solved... I'm completely at a loss! Please help!

Sorry to hear of your problems. I've bought from Stoneacre, new cars with factory warranty and last time when we went to puck up the car, on the morning, brand new but pre registered, they'd sold it to someone else. They manages to get another one, the next day for us but we had to change insurance details, keep our old car also to have insurance back onto..... They were a nightmare. Managed to get about £500 off. So they will have needed to get that money back. So, be warned, they are all crooks. If you have details of car ar £7k and you paid, or took finance out for £8k, then you might have a case for CAB. Good luck Jennifer
 
I'm no expert but if what you are saying, supported by your documentation, then I think this is "small claims court case". I've been told that many defenders back down once a case is started or just fail to appear in court.

Bottom line is this: You were offered, told about and bought in good faith a Lifetime Warranty. If the sales/dealer told porkies, failed to register the warrant correctly, etc. then this is NOT your problem. You have paid and have a legally binding contract with the dealer to be given a Lifetime Warranty. If they have failed to process/register that warranty after receipt of moneys paid then they are a fault and liable.

If you hav proof of the extended warranty cover, that is all you should need. It dos not matter if it paid a a separate item or included in the sale price of the car. Included in the price is not "free". If you have proof of cover, it's up to them to provide proof that it's invalid, not for you to show how it was paid for. Unfortunatly CAB advice can be variable, I don't think you need proof that it was included, but I'm not a lawer. Do your own research or ask a proper lawer, most will give a fixed price consultation. Also check your car and home insurance and any breakdown cover you have as these often have legal advice as a benefit. It's easy to start a small claim on-line, but it can take a while to get a resolution if the garage decides to prevaricate.
